What is a Short-Term Rental?

On June 19, 2019, the City Council adopted an Ordinance establishing Short-Term Rental (STR) regulations.  A Short-Term Rental (STR) is defined as the rental of any legally permitted dwelling unit (or portion thereof) for occupancy for dwelling, lodging, or sleeping purposes for a period of no more than 30 consecutive days.  A STR does not include bed and breakfasts, hotels, motels or timeshares.

 

STRs are allowed throughout the City with the exception of mobile home parks and non-conforming panhandle lots.  A non-conforming panhandle lot is a lot that does not meet city standards set forth in Oceanside Zoning Ordinance Section 1050 (Y).  Please review the Zoning Ordinance for additional information.


All short-term rental properties are required to hold a valid Transient Occupancy Tax (TOT) certificate. If you do not hold a valid TOT certificate please apply via the below link. In addition, effective November 1, 2019, a STR permit is required for all STR properties unless:

  •  The unit is hosted (property owner or tenant remains onsite and offers a portion of the property for rent); or
  •  The unit is part of a gated HOA that contains at least 50 units, meets applicable parking requirements and has 24-hour security or on-site management. 

Hosted properties must submit a signed Affidavit.


Under the provisions of the STR ordinance, if your STR property does not meet criteria (a) or (b) above you must obtain a STR permit.

The STR permit fee is $250 and must be renewed annually.  There is also an initial property inspection fee of $119. Fees are non-refundable.
